Setu Mekonnen v. Ignacia Bustos, et al.
YC072894
Setu Mekonnen’s Motion for Judgment
TENTATIVE RULING
Setu Mekonnen’s Motion for Judgment is denied.
Background
Plaintiff filed the Complaint on May 17, 2018. Plaintiff alleges the following facts. Plaintiff alleges that Defendant, owner of neighboring property, is barring Plaintiff from his land by fencing in both Plaintiff and Defendant’s property, which is causing Plaintiff damages. Plaintiff alleges the following causes of action: 1. Quiet Title; 2. Implied Easement; 3. TRO and Preliminary and Permanent Injunctions.
Motion for Judgment
Plaintiff moves for judgment. Plaintiff states that Defendant’s counsel has not acknowledged his phone calls, texts, correspondences, and requests to produce trial exhibits. (Plaintiff’s Motion, page 1.) Plaintiff also takes issue with a survey conducted by Defendant. (Plaintiff’s Motion, pages 2-3.) Plaintiff’s motion is denied because Plaintiff failed to provide any statutory authority to support Plaintiff’s motion. Plaintiff does not present any authority to support his request that judgment be entered in his favor. In addition, Plaintiff does not provide any authority or evidence to show that the conduct complained of by Plaintiff warrants judgment in his favor and against Defendant.
Defendant is ordered to give notice of this ruling.
