Judge: Glenda Sanders, Case: 2016-00893517, Date: 2022-11-17 Tentative Ruling

The Court has received and considered Plaintiffs’ Motion for Preliminary Approval of Revised Class and PAGA Action Settlement and noted the following issues:

1.    The department should be updated in the Class Notice and proposed Order.

2.    The date of the hearing on this Motion should be updated. See proposed Order, p. 1:4.

3.    Paragraph 6 of the proposed Order should reference the Exclusion Form as part of Exhibit C.

4.    The proposed Order should include the amount of the requested disbursements.

5.    Plaintiffs should propose a date for final approval. Final approval hearings are held on Thursdays at 2:00 p.m.

Plaintiffs are ordered to submit redlined and clean versions of the revised Class Notice and revised proposed Order addressing the above issues within 3 court days. Should the revised Class Notice and revised proposed Order resolve these issues, the Court will GRANT the Motion subject to the following:

$ 12,500.00 total for Plaintiffs’ Enhancement (not to exceed $5,000 each to Guerrero and Vasquez and $2,500 to Orozco); 

$ 213,750.00 for Attorney’s Fees (not to exceed 1/3 of the MSA);

$ 27,901.92 for Litigation Costs (not to exceed);

$ 22,000.00 for Settlement Administrator’s Fees and Costs (Not to exceed); and

$ 18,750.00 for the LWDA’s share of PAGA penalties ($25,000 total allocated to PAGA). 

In the event these issues are not resolved, the Court CONTINUES the hearing to December 15, 2022 at 2:00 p.m.

Plaintiffs are ordered to give notice, including to the LWDA, and to file a proof of service.
