Final Accounting

The court has read Plaintiff’s Proposed Amended Order of Final Approval and Judgment, submitted on September 29, 2022. The court ordered Class Counsel to submit an Amended Order and Judgment, which “shall contain the entire text of this Order and Judgment.”

The court did not receive a redlined version of the September 29, 2022 Proposed Amended Order and Judgment (PAJ). As a result, it is difficult for the court to discern precisely what changes were made to the court’s signed judgment.

A cursory review of the PAJ reveals that Paragraphs 10 and 20-25 of the signed judgment were not included in the PAJ, and  Paragraphs 19-22 of the PAJ have been added. These additions and deletions may be appropriate, but without a redlined version of the PAJ (which must, of course, include the addition of  the cy pres amendment), the court cannot assess the adequacy and completeness of any amended judgment.

Accordingly, the Final Accounting is continued to November 18, 2022, at 1:30 p.m. in Department CX103. Class Counsel shall file a Proposed Amended Order of Final Approval and Judgment (and a redlined version thereof) that complies with this court’s order, no later than 5 court days prior to the continued hearing.
