Motion for Approval of Class and PAGA Settlement

This is a class and PAGA action alleging wage and hour violations.

The parties propose a Gross Settlement Amount of $662,500, with the following deductions:

-      Attorney Fees: $265,000

-      Litigation Costs: $30,000 (not to exceed)

-      Administration Costs: $6,000 (not to exceed)

-      Plaintiff’s Enhancement: $15,000

-      PAGA: $66,250 (75% LWDA, 25% Aggrieved Employees)

This matter was continued so that counsel could address several issues identified by the Court. (ROA 581.) Having reviewed the First Amended Stipulation for Class Action Settlement (ROA 590 Ex. 2) and the accompanying papers, the Court finds the issues identified previously have been resolved.

The motion for preliminary approval is GRANTED with minor non-substantive changes to the proposed Order such as referencing the operative settlement agreement in the Order as Exhibit 2 to ROA 590 (as opposed to the

ROA 558 which has been superseded.)

For final approval as to the proposed enhancement, counsel should state the amount the representative is expected to recover as a class member, and any other factors pertinent to the enhancement request. (Golba v. Dick’s Sporting Goods, Inc. (2015) 238 Cal.App.4th 1251.)  The actual high, low, and average recoveries for class members should also be stated.

The hearing on the Motion for Final Approval is set for December 2, 2022 at 1:30 PM in Dept. CX101 with all papers filed in support of that motion filed no later than fourteen (14) calendar days prior to the hearing.
