Motion for Approval of PAGA Settlement

There is still no proof of service upon the LWDA as required by the Court’s previous order (ROA 164.) The Motion for Approval of PAGA Settlement will be GRANTED as set forth below, after the proof of service has been filed.

The Court approves the following disbursements:

66,333	Attorney’s fees (1/3 of GSA)
9,334.41	Litigation costs (actual)
2,450	Administration costs
3,500	Plaintiff’s enhancement
88,036.94	LWDA share of PAGA (75% of net $117,382.59)

The Court has reduced the amount of requested attorneys’ fees, the amount of Plaintiff’s requested enhancement, and awarded actual costs. The Court finds the above amounts are fair and reasonable. Together with the filing of the proof of service referenced above, counsel shall file a revised Proposed Order and Judgment, including a redline, no later than five calendar days after service of this order. In the proposed Order, the operative settlement must be identified by the ROA number of the declaration to which it is attached.

A Final Accounting is set for July 19, 2023 at 1:30 p.m. in Department CX101. Plaintiff shall submit a final report including the amounts distributed under the settlement on or before June 30, 2023.

The OSC re sanctions is discharged.

The court does not require any physical or remote appearance at the 08-19-22 hearing.
