The hearing on the Motion for Final Approval is CONTINUED to December 15, 2022 at 2:00 p.m. in department CX101 to permit the parties to respond to the following issues. A supplemental briefing shall be filed at least 9 days before the continued hearing and respond where necessary to the points raised below:
1. The Settlement Administrator must confirm that the total number of exclusion requests received is two, whether valid or not. If there are additional exclusion requests, the Settlement Administrator must explain why they are not “valid” and submit all documents pertaining to such requests for exclusion with the Court for review. The Settlement Administrator must also identify the individuals with valid requests for exclusion and their names should be included in the proposed Order.
2. The Settlement Administrator should confirm the deadline for disputes was also September 5, 2022.
3. What is Plaintiff’s estimated Individual Settlement Payment and Individual PAGA Payment?
4. Counsel should explain what accounts for the difference in estimated and actual class size. What steps were made to ensure all class members have been notified?
5. How will notice of the judgment will be provided to the class? The method for providing notice should be included in the proposed Order.
6. The final report that must be filed at least 10 days prior to the conference regarding the status of the settlement administration and final accounting, must include all information necessary for the Court to determine the total amount actually paid to class members and any amounts tendered to the State Controller’s Office under Unclaimed Property law.
Plaintiff is ordered to give notice, including to the LWDA and file a proof of service at least 5 court days before the continued hearing.
