The Court having reviewed the papers, including all supplemental papers, filed in connection with the Motion for Approval of $175,000 Class and PAGA Action Settlement, the parties are to address the following issue: Although the fax number for the Settlement Administrator has been provided, Section 4 of the Class Notice and the Settlement Share Form do not advise Class Members that they may submit a dispute by fax as well as by mail. The Class Notice and Settlement Share Form must be revised accordingly.

Plaintiff is ordered to submit the revised Class Notice and Settlement Share Form within 3 court days. Upon receipt of an acceptable Class Notice and Settlement Share Form, the Court will GRANT the Motion subject to the following:

$ 5,000.00 for Plaintiff’s enhancement (not to exceed); 

$ 58,333.33 for attorney’s fees (not to exceed);

$ 11,000.00 for reasonable litigation costs (not to exceed);

$ 12,000.00 for Settlement Administrator’s fees and costs (not to exceed); and

$ 15,000.00 for the LWDA share of the $20,000 total for PAGA penalties. 

Plaintiff is ordered to give notice, including to the LWDA. Any supplemental brief and/or amendments made pursuant to this Order should also be filed with LWDA, with a proof of service submitted to the Court.
