Having considered all papers, including all supplemental papers, filed in connection with the unopposed Motion for Approval of $1,400,000 PAGA Settlement, the Court GRANTS the Motion subject to the following:

$ 5,000.00 for Plaintiff’s enhancement;

$ 466,620.00 for attorney’s fees;

$ 19,659.54 for reasonable litigation costs ($55.54 in UPS charges deducted as disallowed costs under CCP §1033.5(b)(3) for postage);

$ 9,500.00 for Settlement Administrator’s Fees and Costs; and

$ 899,220.46 total PAGA penalties to be allocated as follows: $674,415.34 to the LWDA (75%) and $224,805.12 to the aggrieved employees (25%).

Plaintiff is ordered to make the following revisions to the Notice and proposed Order and resubmit the revised documents to the Court within 5 court days:

1.    In the Notice, at Section 2, page one, last line, “herself” should be changed to “himself”.

2.    In the Notice, at Section 4, page 2, the first line and the last line, “Defendant” should be changed to “Defendants”.

3.    The attorney contact information should be removed from the caption page of the proposed Order.

4.    The definition for aggrieved employees should be included in the proposed Order.

5.    Paragraph 7(a) of the revised proposed order states that attorney fees are 33% of the Total Settlement Amount, but it should be revised to 33.33%.

Plaintiff is ordered to give notice, including to the LWDA, and file a proof of service.
