Motion for Final Approval of Class Action and PAGA Settlement 

The hearing is CONTINUED to January 12, 2023 at 2 p.m. in Department CX102 to allow Plaintiffs to address the issues identified below. Supplemental declarations or other supplemental materials shall be filed no later than 14 calendar days prior to the continued hearing. 

1.    The hours provided by counsel total 170.9, but the claimed lodestar is based on 384 hours. The Court notes that there is no exhibit attached to the Litwin Declaration.

2.    Please provide the customary rates for each counsel via a declaration.

3.    Why are the number of hours and total lodestar amount doubled at the bottom of Exhibit A of the Wong declaration?

4.    Please provide more detail regarding the costs incurred by the Barkhordarian Law Firm.

5.    Provide proof of service of the moving papers on the LWDA.

As to the Proposed Order (ROA 146):

6.    Correct the hearing date.

7.    Identify the settlement by ROA number (¶ 1).

8.    The following language is unnecessary and should be deleted:  paragraphs 11, 17-18, 20, and 24.

9.    There is a typographical error in paragraph 21 (“Final and Fairness”).

10. Propose a date for the final accounting.

Plaintiffs are ordered to give notice, including to the LWDA, and file a proof of service within seven calendar days.
