The Motion for Approval of Proposition 65 Settlement is CONTINUED to November 18, 2022 at 1:30 p.m. in Department CX101, to permit Counsel to respond to the issues identified below.

 

Counsel purports to submit a revised proposed Consent Judgment to the court for review. However, counsel did not comply with this court’s April 15, 2022 Minute Order, which indicates, amongst other things, that any revised documents must be styled as “amended” or “supplemental” and redlined versions must be provided.

 

The moving party must review this court’s April 15, 2022 order and submit further briefing that complies with that order. Because of the deficiencies described above, the court has not fully reviewed the supplemental briefing submitted for the August 19, 2022 hearing. The court notes, however, that it appears that not all correspondence from the Attorney General has been provided to the court. The Hashemi declaration (ROA 39) seemed to indicate that the Attorney General wrote to Plaintiff’s counsel on at least two occasions, but only one piece of correspondence has been provided to the court.

 

Counsel is advised to take measures to ensure that all supplemental submissions fully comply with and respond to the court’s April 15, 2022 Minute Order.

 

The court has continued the hearing to the first available date. There are no earlier dates available.

The court does not require any physical or remote appearance at the hearing scheduled for 8/19/2022.
