The demurrer of defendants Los Alamitos Race Course and Ed Allred to the Third Amended Complaint is OVERRULED in part and SUSTAINED in part without leave.

The first and second causes of action were part of the Second Amended Complaint.  No demurrer was filed as to them before and competing motions for summary judgment as to these causes of action were denied.  Presumably the defendants are fully aware of what is alleged.  Accordingly, the demurrer as to these two causes of action is OVERRULED.

There are no third and fourth causes in the Third Amended Complaint.  Thus, to the extent the plaintiff seeks relief under them, or the defendants may have demurred to them, those causes of action do not exist.  Accordingly, there is NO RULING to make.

The fifth through eighth causes of action are SUSTAINED without leave to amend.  The court takes judicial notice of the rulings in Los Angeles County.  An unsuccessful litigant in one county cannot properly renew the claim in another county because such claim is barred by the doctrine of res judicata.

An answer shall be filed within 10 days.

The defendants shall give notice.
