The motion of the plaintiff for leave to file a Third Amended Complaint is GRANTED.  The amended complaint shall be filed within 10 days.

Given the fundamental change in the legal landscape (the primary issue as to whether a valid cause of action under the state Lemon Law can be stated as to the sale of a used vehicle has just been taken up by the California Supreme Court), the plaintiff’s desire to pursue federal remedies too should be allowed.

The plaintiff shall give notice.
