The defendant filed a motion to compel further discovery responses. (See Minute Order of July 21, 2022, ROA 392.) According to the Joint Statement submitted by the parties, the discovery issue has been resolved and the motion to compel is therefore DENIED as MOOT.
The only issue remaining is whether discovery sanctions of $2,500 should be imposed.
The court is intimately familiar with this case, the parties, and the issues. Already, 20 or so minute orders have issued addressing numerous matters. In the past, the court gave the plaintiff a “pass” when sanctions could have (and probably should have) been imposed.
The court has again reviewed the court’s file and the discovery request at issue. The court has considered how long it took the plaintiff to provide responses—finally—and how much effort the defendant has put into obtaining discovery it is legally entitled to.
The court ORDERS the plaintiff to pay the defendant monetary discovery sanctions of $2,500 within 30 days of this order. Sanctions are ordered as required by the Civil Discovery Act.
The defendant shall prepare the appropriate order and give notice.
