Defendant Orange County Sanitation District filed a motion to bifurcate the liability and damages phases of the trial currently scheduled for November 7, 2022.  The parties were permitted to file opposition and any reply no later than October 5, 2022, which they did.  The court has read and considered these new filings.

The District indicates that the plaintiff has only now disclosed certain very important, perhaps critical, information regarding damages, and the District will be filing a motion to re-open discovery as to damages.

The court questions whether it would be a better use of its (and a jury’s) time to bifurcate the liability issue at this point with the scope of the issue of damages unclear.
