The underlying motion was continued to this date to permit the parties to arrive at an informal resolution.  The court has been advised that the parties are at an impasse and the court will need to decide the issue.

The court sees no reason to hold further argument as the matter was well fleshed out at the prior hearing.  However, the court will entertain argument if any party elects.  The court will then take the matter under submission.

The defendants shall give notice.
