Judge: Glenn R. Salter, Case: 20-1158188, Date: 2022-08-18 Tentative Ruling

The defendants’ motion for summary judgment and/or summary adjudication of issues is CONTINUED to September 15, 2022, at 1:30 pm.  The plaintiffs shall pay the continuance fee forthwith.

It appears from the declarations submitted that discovery remains outstanding and that they are entitled as a matter of right to a continuance.  (Code Civ. Proc., § 437c, subd. (h).)

If discovery is not completed in time for the continued hearing, the motion will be continued to the trial date.  This case needs to go to trial on October 17, 2022, as currently scheduled.

The court is not inclined to grant any trial continuance, even if stipulated to by the parties.  There have been numerous lawsuits between the parties and the dispute remains open with no end in sight.  At some point there needs to be an end.  If discovery needs to completed during trial, then so be it.

The plaintiffs shall give notice.
