Judge: Glenn R. Salter, Case: 21-1188243, Date: 2022-09-01 Tentative Ruling

Defendant Guardian Commercial Real Estate, LP, filed a motion to compel the continued deposition of the plaintiff for two more days.  It seeks an order to set deposition dates of September 30 and October 3, 2022.

 

The plaintiff suggests the motion is “premature” because it has agreed to sit for a deposition for a half-day more on September 30.  It indicates it is willing to continue to meet and confer about the length of the deposition.

 

At the plaintiff’s request, the motion is CONTINUED to October 13, 2022, at 1:30 pm.  The plaintiff shall pay the continuance fee forthwith.

 

If the matter is not resolved informally between counsel, the parties are ORDERED to file a Joint Status Report with the court no later than October 6, 2022, detailing the status of the deposition.

 

In order to assist counsel in resolving the discovery dispute, the court would indicate, based on the motion and other papers (but not the new evidence submitted by the moving party in the reply declaration), that there have been many changes in the litigation landscape since the deposition was commenced.  It would seem that an additional full day of testimony, and maybe an hour or two more, would be appropriate.  Whether it should include an additional two full days might seem inappropriate.

 

The defendant shall give notice.
