Judge: Glenn R. Salter, Case: 21-1206255, Date: 2022-11-03 Tentative Ruling

The plaintiff filed a motion to enforce the settlement in this Lemon Law case.  The two remaining items to be accomplished appear to be delivery of the settlement check and surrender of the vehicle.

 

The defendant states in its opposition that the settlement check is “in the mail.”  It then explained how the delay was unintentional and was solely the result of having to redo some paperwork.  As for the surrender, the court assumes that once the settlement check has been negotiated the surrender of the vehicle will occur quickly.

 

In reply, the plaintiff indicates that they have heard nothing from the defendant.  They are asking the court to enter judgment in the amount of $33,309.67 and attorney fees in having to bring the motion in the amount of $2,185.

 

The parties should be prepared at oral argument to provide the court with a status report.
