The plaintiff, who is self-represented, filed a “Case Logic and Motion for Discovery.”
It does not appear that the motion was served on any party, and indeed at this point it looks like no party to the action has ever been served with the Summons and Complaint (or the First Amended Complaint which was filed at the same time as the motion.)
Further, the purpose of the motion is unclear. It appears the plaintiff is trying to keep the court apprised of his efforts (unsuccessful so far) to obtain counsel. However, no viable motion is pending. Therefore, the matter will go OFF CALENDAR.
On the court’s own motion, and for good cause, the court sets a Case Management Conference for December 15, 2022, at 8:30 am.
The plaintiff shall give notice of the hearing. The plaintiff is also advised to review Rule 3.110 of the California Rules of Court regarding timelines for service of the Summons and Complaint and the entry of defaults. The court notes that the original complaint was filed September 2, 2021—or over one year ago.
