The unopposed motion of the plaintiffs to appoint an arbitrator is GRANTED. The court appoints Hon. Frederick Aguirre (Ret.) as the arbitrator.
On September 8, 2022, the court granted the defendants petition to compel binding arbitration pursuant to Paragraph 22 of the Residential Purchase Agreement. The court also set an ADR Status Review for December 15, 2022.
When the parties were unable to agree on an arbitrator, the plaintiffs filed an ex parte application to appoint a receiver from a list of three potential candidates. The court set the ex parte application for a noticed hearing.
The defendants have not filed any opposition to the motion and, by implication, do not oppose any of the proposed arbitrators proposed by the plaintiffs.
The court selects Hon. Frederick Aguirre as the arbitrator in this matter. Should he decline, or be unable to act as the arbitrator, the court selects Hon. Francisco Firmat (Ret.) as the arbitrator. On the court’s own motion, the ADR Review hearing scheduled for December 15, 2022, is CONTINUED to June 8, 2023, at 8:30 am.
The plaintiffs shall prepare the appropriate order and give notice.
