Motion to Compel Arbitration

 

The defendant filed a motion to compel arbitration.  The court requested a declaration as to whether the defendant conceded that there was an arbitration agreement that could be enforced.  (See the court’s Minute Order of October 27, 2022, as to why such a declaration was needed.)

 

The defendant filed such a declaration.  But at the hearing, counsel for the plaintiff indicated he had not seen it.  The motion was continued one week on the court’s motion so as to allow the plaintiff a fair opportunity to review the declaration.

 

The court’s minute order of October 27, 2022 (ROA 39) is incorporated herein.  Its tentative ruling is the tentative ruling of the court here.  Thus, the motion to compel arbitration is GRANTED.

 

Case Management Conference

 

Given the order granting the motion to compel arbitration, the Case Management Conference is OFF CALENDAR.

 

ADR Review Hearing

 

On the court’s own motion, the court sets an ADR Review hearing for August 24, 2023, at 8:30 am.
