Judge: Glenn R. Salter, Case: 22-1283723, Date: 2023-07-27 Tentative Ruling

The motion of the plaintiff to quash subpoenas for business records is GRANTED in part and DENIED in part.

The defendants have met their burden to show that they are entitled to the plaintiff’s medical records insofar as they relate to plaintiff’s claims in this action for shoulder, neck, back, right knee, and any claims for dizziness and difficulties with balance.  To that extent the motion is DENIED.  As to other areas of the body the motion is GRANTED on the grounds of privacy.

Records may be sought for a period that encompasses up to ten years prior to the accident.

The defendants shall give notice.
