Denied because Plaintiff designated the same witnesses as experts, however the court will hear argument whether a portion of the fees should be taxed because they did not involve expert testimony, but at least a portion of the testimony concerns the nonrecoverable testimony of a treating physician.

Court Reporters Fees

Granted.  Not ordered by the court pursuant to CCP Section 1033(16)(b)(5) Further, the court finds the fees excessive and unreasonable, likely because they weren’t the ordinary and necessary court reporter fees, but rather premium fees because they were ordered on a rush basis.

Regarding counsels’ alleged agreement to split costs regarding the court reporter transcripts, this is not before the court.
