Cross-Defendants now make an ex parte motion to continue the trial for a month because Michael Tran “fears he will lose his job if he misses another day of work during this project.” (Ex Parte Motion, page 6, lines 3-6)

Cross-Defendants candidly admit that they have previously issued a CCP 170.6 affidavit of prejudice against Judge Bobbi Tilmon “to avoid this date because of Cross-Defendant Michael Tran’s employment situation.” (Ex Parte Motion, page 6, lines 8-12)

Now, after announcing ready for trial, Cross-Defendants stated they need a one-month continuance, for the same reason known prior to the first trial assignment in November.

If Plaintiff agrees to the 30-day continuance, the court will send this case back to the original court for a new trial assignment.
