TENTATIVE RULING

Plaintiffs George Kopek and Toni Kopek’s Motion to Compel Attendance of Defendant Bagram Mardirossian at Deposition pursuant to Court Order dated 2-1-22 is DENIED.  Defendant’s request for sanctions is DENIED.

The Court’s order dated 2-1-22 stated as follows:  “Defendant Bagram Mardirossian will appear for another session of his deposition not to exceed seven hours, including at least one hour dedicated to examination on behalf of the HOA.”  The Court ordered one additional session of Mardirossian’s deposition, not to exceed seven hours.  The Court did not order Mardirossian to sit for another seven hours of deposition.  All parties agree that Mardirossian has sat for two additional sessions of deposition since the Court’s 2-1-22 order.  Mardirossian has fully complied with the Court’s 2-1-22 order.  Plaintiffs’ request that Mardirossian sit for a fifth deposition session is DENIED.
