TENTATIVE
RULING
Defendants
Integrated Media Systems, Inc. and Mohammed R. Ahmadi’s Motion to Compel
Compliance with Inspection Demand Nos. 1-3, 5, 7, 9, 10, 12, 14-19, 21-23 and
25 is MOOT as to the demands. Plaintiff produced
responsive documents on 8-4-23. However,
Plaintiff did not produce the documents until after Defendants filed this
motion, despite having promised at the 5-22-23 hearing date to comply with its
responses to the Subject Demands by 6-5-23.
In addition, Defendants were not required to file a separate statement
per CRC Rule 3.1345, nor does CCP §2031.320 require that parties meet and
confer prior to filing a motion to compel compliance.
Sanctions
are still at issue. Plaintiff and
Plaintiff’s counsel are ordered to pay sanctions in the amount of $3,060 (5
hours @ $600/hr plus a $60 filing fee) within 10 days.
