TENTATIVE RULING

Defendants Ani Asatryan and Murad Minasyan Application for Determination of Good Faith Settlement is GRANTED. Defendants have met the requirements for a determination of good faith settlement pursuant to CCP §§ 877 and 877.6. Defendants filed and served Plaintiffs Oshri Lankri, an incompetent, by and through his Guardian Ad Litem Tanaz Kahen, and Tanaz Kahen with the application on 12-2-24. Plaintiffs have not filed an opposition as of 3-25-25.

 

The Court finds that the settlement agreement described in the Application was made and entered into in good faith between Plaintiffs and Defendants within the meaning and effect of Code of Civil Procedure section 877.6.

 

The Court orders Plaintiffs First Amended Complaint as to Defendants Ani Asatryan and Murad Minasyan DISMISSED WITH PREJUDICE.

 

The Court orders that this determination of good faith shall bar any other joint tortfeasors or co-obligor from pursuing any further claims or cross-complaints against Defendants/Cross-Defendants, CHOE, for equitable distribution, comparative contribution, or partial or comparative indemnity based on theories of comparative negligence or comparative fault.
