TENTATIVE RULING

            Plaintiff Elena Linda Bongiovanni’s Motion for Leave to Amend Complaint is GRANTED. The motion is unopposed. Plaintiff has attached the amended pleading to the motion and supplied a declaration satisfying the procedural requirements of Cal Cal. Rules of Court, rule 3.1324(b). (See Houston Decl., ¶¶ 4–10; Ex. A.) The proposed amendment is timely and will not prejudice the Defendants as the motion is unopposed and there will be no delay in trial as a trial date has not been set. Furthermore, the proposed amendments are in accordance with CCP §§ 473(a)(1), 580, and 379(a)(1).  Plaintiff to separately file the amended complaint forthwith.
