The Court has considered the moving papers.  No opposition papers were filed.  Any opposition papers were required to have been filed and served at least nine court days before the hearing under California Code of Civil Procedure section 1005, subdivision (b).

BACKGROUND

Plaintiff’s complaint (the “Complaint”) alleges: (1) breach of written contract; and (2) common count – services rendered. 

On September 19, 2023, Plaintiff filed a motion to compel further responses to the Form Interrogatories that were propounded on Defendant (the “Motion”). 

On October 4, 2023, Plaintiff filed a Notice of Settlement indicating that Plaintiff and Defendant had agreed to settle this matter, and on November 28, 2023, a judgment was entered on the Complaint.

Given that this matter has settled and a judgment has been entered, the Motion is MOOT.

Moving party is ordered to give notice of this ruling.
