MOVING PARTY:  Plaintiff Certain Underwriters at Lloyd’s, London Subscribing to Policy NO. L20300-037_CA, as subrogees of Sunset Plaza Living, LLC (“Plaintiff”)

RESPONDING PARTY: None

 

            The Court has considered the moving papers. No opposition has been filed.

BACKGROUND

            This is a subrogation action arising from an alleged breach of a real property lease agreement, in which tenants are alleged to have caused substantial damage to the leased premises. On February 14, 2024, Plaintiff filed the operative complaint (“Complaint”) against Triller, Inc., Michael Gruen, Griffin Johnson, Kio Cyr, Quinton Griggs and Josh Richards (collectively “Defendants”) alleging causes of action for: (1) negligence; (2) breach of contract; and (3) negligent supervision or retention of employees.

 

            On January 3, 2025, Plaintiff filed the instant motion for application for order for publication of summons (the “Motion”).     

 

DISCUSSION

            An application and order for publication must be submitted using the mandatory Civil Forms. Civil Form LACIV-108 is used for the application and Civil Form LACIV-145 is used for the order. A separate application and order are required for each defendant. Plaintiff must resubmit the application using the proper forms before the Court can review it.   

 

            The Motion is DENIED, without prejudice.

 

Moving Party is ordered to give notice of this ruling.
