The Court has considered the moving papers.
The motion is unopposed.
BACKGROUND
This is an employment action. On June 4, 2024,
Plaintiff filed the operative complaint (“Complaint”) alleging causes of action
for: (1)
failure to pay wages (Labor Code §§ 201, 1194); (2) failure to provide meal and
rest periods (Labor Code §§226.7, 512); (3) failure to provide itemized wage
and hour statements (Labor Code §§226, et seq.); (4) waiting time penalties (Labor
Code §§201-203); (5) failure to permit inspection of personnel and payroll
records (Labor Code §1198.5); (6) Private Attorney General Act (Labor Code
§2699, et seq); and (7) unfair competition (Bus. & Prof. Code §17200 et
seq.).
On August 30, 2024, Defendant filed
the instant motion to compel arbitration (the “Motion”). On January 14, 2025,
Plaintiff filed a notice of non-opposition indicating that the parties had
agreed to arbitrate the matter.
Accordingly, Defendant’s Motion to
Compel Arbitration is GRANTED. This action is stayed pending completion of
arbitration. A Status Conference re
arbitration is set for October 17, 2025 at 8:30 a.m. The parties are ordered to file a Joint
Status Conference Report re Arbitration at least seven court days before the
Status Conference.
Moving
Party is ordered to give notice of this ruling.
Parties who intend to submit on this
tentative must send an email to the Court at SMC_DEPT56@lacourt.org as directed
by the instructions provided on the court website at www.lacourt.org. If the department does not receive an email
and there are no appearances at the hearing, the motion will be placed off
calendar.
