            The Court has considered the moving papers.  No opposition papers were filed.  Any opposition papers were required to have been filed and served at least nine court days before the hearing under California Code of Civil Procedure (“CCP”) section 1005, subdivision (b).

 

BACKGROUND

            This action arose out of a dispute over an encroachment onto real property. On April 17, 2018, Defendant/Cross-Complainant Marta A. Alcumbrac (“Alcumbrac”) filed a cross-complaint (the “XC”) against George Stanciu (“Mr. Stanciu”), among others.  Ms. Stanciu was not named in the XC.  On November 20, 2020, default judgment was entered against Mr. Stanciu.  On August 16, 2022, Ms. Stanciu filed a motion to expunge lis pendens (the “Motion”).
