Defendants' Motion for Bifurcation of Plaintiffs' Equitable Alter Ego Claim is granted in part.
There is no dispute between the parties that alter ego liability is an equitable issue for the Court to decide and should be bifurcated from the legal issues presented to the jury. Therefore, the only issue is whether the alter ego issues should be adjudicated before or after the jury trial on Plaintiffs' legal claims.
Alter ego liability is dependent upon a finding of liability against Defendant Palm Avenue Recycling, L.P.
and will not obviate the need for a jury trial if adjudicated first. Contrarily, a jury verdict in Defendants' favor will moot the alter ego issue. Therefore, the Court finds that judicial economy and the ends of justice are best served by bifurcating the question of alter ego liability and, if necessary, adjudicating the issue following a jury trial on Plaintiff's legal claims.
