Defendant First American Specialty Insurance Company's ('First American') Motion to Compel Plaintiff Jose Villena's Further Responses to Special Interrogatories, Set Two is granted.
The Court has already ordered that Jose produce objection-free responses to these Special Interrogatories. (ROA 157.) Therefore, there is no basis to object to these requests. Objection-free supplemental responses are due within fourteen (14) days.
Defendant is awarded monetary sanctions of $1,290 against Jose, to be paid within ninety (90) days.
-- First American's Motions to Compel Plaintiff Rizalina Villena's ('Rizalina') Further Responses to Special Interrogatories, Set One and Request for Production of Documents, Set One is granted in part.
Additionally, First American's Motion That Matters Set Forth in its Requests for Admissions, Set One, to Rizalina be Deemed Admitted is granted in part.
The Court order's Rizalina to provide objection-free responses to Special Interrogatory Nos. 14-31 and to provide verifications for her responses to Requests for Production of Documents, Set One. These are due within fourteen (14) days. The Court denies Defendant's request to deem as admitted the Requests for Admission, Set One. However, the Court finds it appropriate to award monetary sanctions for the above motions. The Court finds that two (2) hours for each motion and one hour for the hearing at an hourly rate of $225 is reasonable. Therefore, Defendant is awarded sanctions of $1,755 against Rizalina, to be paid within ninety (90) days.
