CASE TITLE: CASE TYPE:
Civil - Unlimited  Other employment Motion Hearing (Civil) 37-2020-00040555-CU-OE-CTL HADLEY VS INDEPENDENT FINANCIAL SERVICES GROUP INC [IMAGED] CAUSAL DOCUMENT/DATE FILED:
Defendant Independent Financial Services Group, Inc.'s Motion to Compel Supplemental Responses to Special Interrogatories, Set One and Motion to Compel Supplemental Responses to Requests for Production of Documents, Set One are granted.
Plaintiff's response to each of Defendant's Special Interrogatories identified the same 54 pages of documents. However, when responding to an interrogatory with a compilation pursuant to CCP § 2030.230, the documents must be identified with 'sufficient detail to permit the propounding party to locate and to identify, as readily as the responding party can, the documents from which the answer may be ascertained.' It is not enough to simply produce a stack of documents and make the responding party search for the relevant information within. Therefore, Plaintiff is ordered to provide supplemental responses to these interrogatories to provide the required level of specificity.
As to Defendant's Requests for Production, Plaintiff is ordered to provide supplemental responses either removing the privilege/work-product objections or providing a privilege log compliant with CCP § 2031.240(b)(2) & (c)(1). (See also Catalina Island Yacht Club v. Superior Court (2015) 242 Cal.App.4th 1116, 1130 ('[A] privilege log typically should provide the identity and capacity of all individuals who authored, sent, or received each allegedly privileged document, the document's date, a brief description of the document and its contents or subject matter sufficient to determine whether the privilege applies, and the precise privilege or protection asserted.').) Defendant is awarded monetary sanctions of $1080.
Supplemental responses are due within fourteen (14) days.
The minute order is the order of the Court.
