The Court grants, in part, the following motions to compel further responses filed by Plaintiff: (1) Form Interrogatories (Set Two), (2) Requests for Production (Set Three), (3) Requests for Admission (Set One) and (4) Special Interrogatories (Set Two).

The Court finds that the discovery requests related to police presence on the Newport sidewalk and the nearby parking lot and the work conducted by the San Diego City Graffiti Program are reasonably calculated to lead to the discovery of admissible evidence. However, the discovery requests related to police presence at Mike's Taco Club and Ocean Beach Hotel, as well as any police video footage of the area is an improper intrusion into the privacy rights of the police officers and third-party citizens. The privacy rights of individuals and the undue burden these requests place on Defendant outweigh the limited, if any, relevance of these requests.

As to Plaintiff's Form Interrogatories, Defendant has agreed to supplement its responses to Form Interrogatory Nos. 16.3, 16.4, and 16.5. To the extent these responses have not already been provided, they are included in the Court's Order. Form Interrogatory 17.1 pertains to the Requests for Admission.

Supplemental responses to Form Interrogatory 17.1 are ordered in conjunction with the Requests for Admission.

In sum, Defendant is ordered to provide supplemental responses to Plaintiff's (1) Request for Production of Document Nos. 30-39, 45, 46, 52, 53, and 56-58; (2) Special Interrogatory Nos. 31-33, 39, 40, 44-49, 54, and 55; (3) Request for Admission Nos. 2-9, 15, 16, and 19-24, with accompanying responses to Form Interrogatory 17.1; and (4) Form Interrogatory Nos. 16.3, 16.4 and 16.5.

Plaintiff's Motions to Compel Further Responses are denied as to Plaintiff's (1) Request for Production of Document Nos. 40-44, 47-51, 54, 55, and 59-64; (2) Special Interrogatory Nos. 22-30, 34-38, 41-43, 50-52, and 56-71; and (3) Request for Admission Nos. 10-14, 17, 18, and 25-30.

The minute order is the order of the Court.
