CASE TITLE: CASE TYPE:
Civil - Unlimited  PI/PD/WD - Auto Motion Hearing (Civil) 37-2023-00002051-CU-PA-CTL DEMARTINO VS KHALIL [IMAGED] CAUSAL DOCUMENT/DATE FILED:
The Court will hear from applicant as to whether applicant has applied to appear pro hac vice in any California case within the last two years.
Rule 9.40(d)(5) requires a pro hac vice applicant to identify '[t]he title of each court and cause in which the applicant has filed an application to appear as counsel pro hac vice in this state in the preceding two years, the date of each application, and whether or not it was granted'.
The application submitted by Emily Weissenberger states that 'Ms. Erickson has not made repeated appearances in California courts, as contemplated by Rule 9.40 of the California Rules of Court.' (ROA 39, pg. 3.) However, Ms. Erickson's declaration does not identify any cases within the last two years in which she filed a pro hac vice application or state that she has not made any such applications. Without this information, Ms. Erickson's application is incomplete.
