CASE TITLE: CASE TYPE:

Civil - Unlimited  Breach of Contract/Warranty Motion Hearing (Civil) 37-2023-00005255-CU-BC-CTL SCHNEIDER VS. SCHNEIDER [E-FILE] CAUSAL DOCUMENT/DATE FILED:

Defendant Ronald D. Schneider's Motion to Consolidate is continued to July 12, 2024, at 9:00a.m.

Roger Schneider ('Roger') and Christian Schneider ('Christian') are named Defendants in Schneider v. Schneider, Case No. 37-2024-00005434-CU-OE-CTL ('Partition Action'). A review of the ROA in the Partition Action indicates that Roger was personally served on March 15, 2024, and Christian was purportedly served via substitute service on May 14, 2024. (ROA 12, 13.) Because service on Christian is still at issue, the consolidation motion is premature.

Roger is currently represented by Astuno Sabel, APC, such that service of the motion on counsel is sufficient to establish service on Roger. However, based on the representation that Astuno Sabel, APC does not currently represent Christian in the Partition Action, Defendant must serve treat Christian as unrepresented until informed otherwise. Consequently, the motion is continued to allow proper service on Christian.

The minute order is the order of the Court.
