Plaintiff's Motion to Compel Compliance with Demands for Inspection, Set One, and Motion to Compel Further Responses to Demands for Inspection, Set One are granted.
The Court finds that the discovery sought is discoverable and should be produced. However, the Court is cognizant of Defendants' concern as to the handling of its confidential documents. To that end, the Court orders that any confidential/highly confidential documents included in a motion to the Court must be lodged with the Court and may not be filed as exhibits on the public record. Furthermore, Defendants are permitted to redact the names and identifying information of any third parties who are not parties to this case. Finally, the Court is open to a motion to seal as to the confidential/highly confidential documents publicly filed in connection with this motion.
The Court denies Plaintiff's request for attorney's fees. By publicly filing, and therefore, disclosing confidential/highly confidential documents to individuals outside those identified in the protective order, Plaintiff created a substantial justification for Plaintiffs to withhold production of further documents absent additional protections.
Supplemental responses and productions are due within twenty-one (21) days.
The minute order is the order of the Court.
