Motion to be Relieved as Counsel of Record

The motions filed by attorney Nam T. Tran from the Law Office of Nam T. Tran to be relieved as counsel of record for plaintiff Thanh Tran is CONTINUED to October 13, 2022 at 10:00 AM.

There are two issues with the moving papers.

First, California Rules of Court, Rule 3.1362, subdivision (d) requires that: “The notice of motion and motion, the declaration, and the proposed order must be served on the client and on all other parties who have appeared in the case.” Moving Attorney has not filed a Proof of Service showing that the moving papers were served on the client and all other parties who have appeared in the case.

Second, the moving papers fail to include the required Order Granting Attorney’s Motion to Be Relieved as Counsel – Civil. (Cal. Rules of Ct., Rule 3.1362(e) [“The proposed order relieving counsel must be prepared on the Order Granting Attorney’s Motion to Be Relieved as Counsel – Civil (form MC-053) and must be lodged with the court with the moving papers.”)

The hearing on the Motion is CONTINUED to October 13, 2022 at 10:00 AM.

Moving attorney is to give notice and to serve the Notice of Motion, Declaration and a Proposed Order with the new hearing date on the client and all other parties who have appeared in the case.
