Plaintiff Susan Longardino’s motion to strike defendant FCA US LLC’s (“FCA”) objections and compel further responses to Plaintiff’s Requests for Production of Documents, Set One Nos. 1, 8, 10, 11, 12, 16, 17, 18, 20, 21, 22, 23, 27, 28, 30, 31, 32, 33, 43, 70, 71, 72, 73, 74, 75, 76, 77, 78, 79, 80, 81, 82, 83 (“Requests”) and production of all responsive documents corresponding to those Requests is DENIED as MOOT.

On December 2, 2022, FCA served supplemental responses to Plaintiff’s Requests for Production of Documents, Set One. (Hanna Decl., ¶ 8, Ex. A.) The supplemental responses provide a further response to each of the Requests at issue in this Motion, therefore, the Motion is MOOT.

Sanctions remain at issue. (Cal. Rules of Court, Rule 3.1348(a); Code Civ. Proc., § 2031.310, subd. (h).) FCA is ORDERED to pay $1,740 in sanctions to Plaintiff within 30-days of the notice of this ruling.

This order is without prejudice to a subsequent motion by Plaintiff as to Defendant’s responses and production, if further meet and confer efforts are unsuccessful. (Sinaiko Healthcare Consulting, Inc. v. Pacific Healthcare Consultants (2007) 148 Cal.App.4th 390, 409.)
