At oral argument on the motion to compel, Plaintiff's Counsel claimed that he had served discovery responses prior to the filing of the motion and that therefore sanctions should not be imposed.

The Court continued the hearing with respect to the imposition of sanctions and ordered Plaintiff to file proof that the responses were served prior to the filing of the motion.

Plaintiff did not do so.  Instead, Plaintiff filed a document totaling over 200 pages, but never answered this question.

Therefore, the Court imposes sanctions in the amount of $832.50 as originally sought.  Moreover, the Court imposes additional sanctions totaling $1,480 in connection with the work necessitated by Plaintiff's filing. In fact, there should not have had to be any continued hearing or filing because Plaintiff did not file a discovery response prior to the motion being filed as represented to the Court.

Thus, sanctions totaling $2,312.50 are due.

$832.50 in sanctions are imposed against Plaintiff and due within 10 days after the date of this order.

$1,480 in sanctions are imposed against Counsel Hesam D. Yazdanpanah because it was his untrue representations that caused the additional work. The sanctions are due within 10 days after the date of this order.
