PLAINTIFF CINAMOM’S GOODIES, INC.’S MOTION FOR ATTORNEY'S FEES, COSTS AND EXPENSES

The motion is granted. 

Plaintiff was the prevailing party at trial.

Pursuant to the contract between the parties, Plaintiff's attorney seeks attorney's fees in the amount of $48,605, for 115.50 hours of attorney time at the rate of $425 per hour.

The Court does not find the amount of time spent on the case (approximately three weeks of time assuming 40 hours of work per week) to be unreasonable for a case that went to trial, including on a cross-complaint filed by Defendants. 

However, for the reasons stated by Defendants, the Court does find the hourly rate to be excessive and reduces it to $300 per hour.

Attorney's fees in the amount of $34,650 are awarded for 115.5 hours of time at the hourly rate of $300 per hour.

Costs in the amount of $1,842.79 are also awarded.

The total awarded is $36,492.79.

Moving party to provide notice and to file proof of service of such notice within five court days after the date of this order.
