Motion to Continue Trial
DECISION
Good cause having been shown, the motion is granted.
The current trial and FSC dates are advanced and vacated.
Trial is set for May 22, 2023 at 8:30 a.m. in Department 30.
FSC is set for May 8, 2023 at 10:00 a.m. in Department 30.
All discovery and motions are closed, except for (1) motions in limine; (2) the depositions of previously designated experts; (3) the depositions of the PMK from Docs Surgical and any other fact witnesses who were previously noticed for deposition; and (4) any further discovery resulting from the court’s rulings on the motions currently reserved/scheduled.
The parties are ordered to file an agreed upon schedule for the completion of outstanding depositions by February 22, 2023. The dates should be cleared with the witnesses, including the experts. The Court sets a Status Conference Re: Schedule for Completion of Depositions for February 23, 2023 at 10:00 a.m.
To the extent that the parties wish to participate in mediation, they are ordered to do so prior to the Final Status Conference date.
The parties should not anticipate any further trial continuances. The May 22, 2023 is a firm trial date and the parties should be prepared and ready to proceed with trial on said date.
Moving party is ordered to provide notice and to file proof of service of such notice within five court days after the date of this order.
