DECISION
The motion is granted.
An OSC Re: Dismissal for Failure to File Proof of Service with respect to Defendant Vicente Cadena, Jr./OSC Re: Failure to Enter Default with respect to Defendant Big Two Auto Part Inc./Trial Setting Conference is set for August 19, 2022 at 8:30 a.m.
It is ordered that Proof of Service must be filed at least three days in advance of the OSC date.
If proof of service is not filed by that time, the Court will dismiss the case with respect to Defendant Vicente Cadena, Jr. pursuant to Code of Civil Procedure Sections 583.410 and 583.420 and California Rules of Court 3.110(b) and (f).
Plaintiff offers no explanation as to why service has not been made and why service of the other Defendant was only effectuated on April 26, 2022, after Plaintiff was made aware of the Court’s dismissal of the case.
Moving party is ordered to provide notice and to file proof of service of such notice on Defendant Big Two Auto Part Inc. within five Court days after the date of this order.
