Decision:

Good cause having been shown, the motion to continue trial is granted.

The current trial and FSC dates are advanced and vacated.

Trial is set for January 17, 2024 at 8:30 a.m. in Department 30.  

Motion to Bifurcate is also continued to January 17, 2024 at 8:30 a.m. in Department 30.

FSC is set for January 3, 2024 at 10:00 a.m. in Department 30.

Motion cutoff date, discovery cutoff date, expert exchange date and all other dates are to comport with the new trial date of January 17, 2023.

Note:  Defendant to confirm release date with the proper authority before asking for another continuance based upon Defendant Martinez’ incarceration.

There being no proof that Defendants Joseph Goldberger and John Michael Taferner have yet  been served with the summons and complaint, the Court orders the aforementioned defendants dismissed without prejudice, pursuant to CCP 583.410, 583.420(a)(1) and CRC – Rule 3.110(b) and (f), for failure of Plaintiff to effectuate service within the statutory time.

Moving party is ordered to provide notice and to file proof of service of such notice within five court days after the date of this order.
