Motion to Continue Trial
DECISION
Good cause having been shown, the motion is granted.
The motion to bifurcate set for 6/20/2023 is continued to the trial date of 06/23/2023 at 8:30 a.m. in Department 30 of the Spring Street Courtouse.
The motion to bifurcate is set for the same date as the trial as the motion will be decided by the trial judge. The motion papers should be part of Tab B in the Trial Binder.
The parties are ordered to include filed versions of the motion and any opposition in Tab "B" of the Trial Binder, behind any motions in limine.
Counsel for the Moving party on the Motion to Bifurcate is ordered to file the Motion (as currently it is only reserved) and notice it for the Trial date of 06/23/2023 at 8:30 a.m., as the Court has continued the hearing on said motion to bifurcate to the continued trial date.
The current trial and FSC dates are advanced and vacated.
Trial is set for June 23, 2023 at 8:30 a.m. in Department 30.
FSC is set for June 9, 2023 at 10:00 a.m. in Department 30.
The motion cutoff date shall comport with the March 21, 2023 trial date, except for discovery motions and motions in limine with respect to which the cutoff dates shall be based upon the June 23, 2023 trial date.
The discovery cutoff date, expert exchange date and all other dates not discussed above are to comport with a trial date of June 23, 2023.
To the extent that the parties wish to participate in mediation, they are ordered to do so prior to the Final Status Conference date.
The parties should not anticipate any further trial continuances. The June 23, 2023 is a firm trial date and the parties should be prepared and ready to proceed with trial on said date.
