DECISION

The motion is denied.

A motion to compel further must be made within 45 days after service of the response or supplemental response and failure to do so divests the court of jurisdiction. (CCP Section 2030.300(c); Deyo v. Kilbourne (1978) 84 CA3d 771, 789) The parties may extend this time limit by written stipulation. (CCP Section 2030.300(c))

Here, there was a written agreement to extend the time to file a motion to compel further until June 13, 2022. (Aghakhani Decl., Ex. 3.) The motion at issue here was not filed until June 28, 2022.
