DECISION
The motion is granted.
Pursuant to Code of Civil Procedure Section 473(c)(1)(A) the Court imposes a penalty of $500 on Plaintiff’s counsel of record.
The funds are due to the Clerk of the Court within 20 days after the date of this order.
This action was filed on October 1, 2020. In addition to failing to appear for trial, Plaintiff has never filed any proof of service in the case.
The Court sets an OSC Re: Dismissal for Failure to File Proof of Service for December 9, 2022 at 8:30 a.m. Proofs of service covering all defendants must be filed at least three court days in advance of December 9, 2022.
If no appearance is made at the next scheduled hearing date and no proof of service is filed prior to the next scheduled hearing date, the Court will dismiss this case pursuant to Code of Civil Procedure Sections 583.410, 583.420 and California Rules of Court, Rule(s) 3.110(b) and (f).
