Motion to Compel Second Deposition of Plaintiff

Ruling:  Granted.  Plaintiff's objections to relevancy are overruled.  Plaintiff is to sit for a second deposition within 30 days of service of this order.

Sanctions in the amount of $780 for attorney fees and $60 in filing fees are ordered against Plaintiff and Plaintiff's attorneys, jointly and severally, and to be paid within 30 days.

Moving party to give notice. 

Rationale:  The Court finds that the information about Plaintiff's prior accident from 12-13 years ago is relevant to whether the subject collision exacerbated any pre-existing injuries. Plaintiff describes the collision as a  "very bad rear-ender."  Plaintiff also states that he had never suffered any prior neck injuries.  Court finds good cause exists for defense to explore this line of inquiry due to its relevance on disputed issues.
